Terms of Service

Welcome to Balcony. Balcony provides digital event invitation services that allow users to create, customise, publish, and share digital invitations.

Balcony is currently operated by an individual service provider in India and is not a separate incorporated company or legal entity.

By creating an account, purchasing a template, creating an invitation, or using Balcony, you agree to these Terms.

1. Accounts

  • You must provide accurate information when creating an account and complete email/OTP verification where required.
  • You are responsible for keeping your account secure and for all activity performed through your account.
  • You must be legally capable of entering into a binding agreement to use paid services.

2. Purchases and Payments

Balcony may provide digital invitation templates and related services for a one-time payment.

Unless specifically stated otherwise:

  • There are no subscriptions or recurring charges.
  • The price displayed at the time of purchase applies to that transaction.
  • Payments may be processed by third-party payment providers.
  • Applicable taxes may be charged where required by law.

3. Refunds

  • Because Balcony provides digital products and services that may become available for immediate use after purchase, purchases are generally non-refundable.
  • If you are charged incorrectly, charged more than once, or do not receive the purchased service because of a technical problem, please contact us.
  • Nothing in this section excludes any refund, consumer right, or legal remedy that cannot legally be excluded under applicable Indian law.

4. Your Content

  • You retain ownership of the text, photographs, event information, and other content you upload (“Event Content”).
  • You give Balcony permission to store, process, display, and transmit your Event Content only as necessary to provide and operate the Service.
  • You are responsible for ensuring that you have the necessary rights and permissions to use the content you upload.

5. Templates and Intellectual Property

  • Balcony’s templates, designs, software, code, graphics, logos, and other materials belong to or are licensed to Balcony.
  • Purchasing a template gives you permission to use it for your event; it does not transfer ownership of the template.
  • You may not copy, resell, redistribute, extract, reverse engineer, or use Balcony templates to create a competing service.

6. Guest Information

  • Hosts may enter Guest information and receive RSVP responses through their invitations.
  • Hosts are responsible for ensuring that they have the appropriate permission or lawful basis to provide Guest information to Balcony.
  • Hosts should not collect or publish unnecessary sensitive personal information.
  • Guests may contact the Host or Balcony regarding their personal information, subject to applicable law.

7. Acceptable Use

You must not use Balcony to:

  • Conduct unlawful, fraudulent, or harmful activities.
  • Upload illegal, abusive, defamatory, or infringing content.
  • Violate another person’s privacy or intellectual-property rights.
  • Access another user’s account or invitation without permission.
  • Send spam or abuse the Service.
  • Attempt to damage, disrupt, scrape, or bypass the security of Balcony.
  • Introduce malware or harmful code.

We may suspend or terminate accounts that violate these Terms or applicable law.

8. Invitation Links

  • Some invitations may be accessible through a unique URL.
  • Anyone who obtains an invitation link may potentially view the information available through that invitation.
  • Hosts are responsible for deciding what information they publish and share.

9. Service Availability

  • We will make reasonable efforts to keep Balcony available, but we do not guarantee uninterrupted or error-free operation.
  • The Service may be temporarily unavailable because of maintenance, technical problems, security issues, hosting or third-party service failures, or circumstances outside our reasonable control.

10. Account Termination and Data Deletion

  • You may stop using Balcony or request deletion of your account.
  • We may suspend or terminate accounts that violate these Terms, create security risks, involve fraud, or violate applicable law.
  • Some information may be retained where required by law or reasonably necessary for security, accounting, dispute resolution, backups, or other legitimate purposes.

11. Privacy

Your use of Balcony is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal data.

12. Liability

  • Balcony is provided on an “as available” basis.
  • To the maximum extent permitted by law, Balcony is not responsible for indirect or consequential losses resulting from the use or inability to use the Service.
  • For a paid Service, and subject to applicable law, our total liability relating to that purchase will generally not exceed the amount paid for that purchase.
  • Nothing in these Terms excludes any liability or consumer protection that cannot legally be excluded under Indian law.

13. Changes to the Service and Terms

  • We may change, add, or remove features from Balcony.
  • We may also update these Terms from time to time. Material changes may be communicated through the website or email where appropriate.
  • The updated Terms will include a new “Last updated” date.

14. Governing Law

  • These Terms are governed by the laws of India.
  • Subject to applicable law, disputes will be subject to the jurisdiction of the competent courts in Pune, Maharashtra, India.
  • Nothing in this section prevents a consumer from exercising rights available under applicable Indian law.
